"Archers Wood - No Real Answers"

The Fingal County Manager's reply to my recent question on taking-in-charge at Archers Wood has raised serious further questions.
Motion:
"That the Manager supply a map of Archers Wood Estate, Clonee, Dublin 15 showing the common area which will be taken in charge by the Council."
Report:
No valid request has been received by the County Council to take the Archers Wood development in charge. Earlier this year correspondence was received by the Council from Managing Agents on behalf of the Management Company of the Archers Wood Development in regard to taking in charge of areas adjacent to the houses in this development.
The Managing Agents have been requested to advise on the legal status of the Management Company vis-a-vis title to lands to be offered for taking in charge and to confirm that the Management Company represent the intentions of residents in this regard. A reply is awaited.
If a valid request is received together with appropriate as constructed drawings, surveys of services and certifications in regard to the construction of the estate it will be included in the Councils programme for the taking in charge of estates. The estate will be surveyed and the completion of outstanding works will be pursued. On completion of any outstanding works the final as constructed drawing of the areas to be taken in charge will be finalized to enable the statutory procedure to take the estate in charge to be initiated.
Michael says:- "a serious issue here is whether the developer or the management company is responsible, for example for the "as constructed drawings, surveys of services", as well as various other certificates. If the management company has to do this, the cost will possibly fall on the residents.
This, of course, brings us to the question of the developer's bond.
I have lodged a motion asking the County Manager to immediately sequester the developer's bond so that the necessary work is done in order that progress on taking in charge can be made."
